A sexual assault lawsuit filed in opposition to Steven Tyler has been dismissed, after a decide dominated the Aerosmith singer’s actions didn’t current “serious risk of physical injury” to the plaintiff.
The case stemmed from an incident in 1975. Model Jeanne Bellino, who was 17 on the time, claimed that Tyler “stuck his tongue down her throat, and put his hands upon her body, her breasts, her buttocks and her genitals” inside a New York telephone sales space. The Aerosmith singer allegedly rubbed his physique on the lady and pretended to have intercourse with her whereas his bandmates and different members of their entourage watched and laughed. A second incident came about later that day in a lodge foyer, at which level Bellino rapidly left.
Bellino claimed she suffered “great pain of mind and body” and “severe and permanent emotional distress” on account of the incident. She introduced the case ahead in November as a part of New York City’s Victim of Gender-Motivated Violence Protection Act, a legislation which prolonged the statute of limitations for sure alleged sexual assaults.

However, U.S. District Judge Lewis Kaplan decided Bellino’s accusations didn’t qualify underneath the legislation as a result of Tyler’s actions didn’t pose “serious risk of physical injury.”
Tyler’s attorneys had argued that Bellino might have introduced her case ahead earlier underneath two earlier state legal guidelines, the Child Victims Act and Adult Survivors Act, each of whom’s home windows to file claims had expired. They argued that not doing so confirmed a “lack of diligence” on the lady’s half. In dismissing the case, Judge Kaplan sided with the rock star’s attorneys.
In an announcement to Bravewords, Tyler’s lawyer stated: “We agree with the judge’s reasoning, and are grateful for this result on behalf of our client.”
TMZ notes that Bellino has till March 13 to amend and resubmit her case.
